Interpretation in the context of tariff-compliant service invoicing according to TARMED

14. Juni 2024 – The interpretation of tariffs is currently subject to judicial assessment as service providers and health insurers disagree on the correct application of emergency and urgent lump compensation under the TARMED tariff structure. The inconsistent cantonal case law on this issue is currently awaiting clarification by the Federal Supreme Court. In practice, this interpretation controversy has already led to ongoing legal and financial uncertainty in the area of outpatient emergency care and has sparked political debate, highlighting the need for clear tariff interpretation mechanisms and parameters to resolve ongoing disputes. Mirjam Olah, Senior Associate at Walder Wyss, examines in her article in the SZS (Schweizerische Zeitschrift für Sozialversicherung und berufliche Vorsorge) the interpretation mechanisms used in the context of tariffs, the specific parameters that can be used to overcome interpretation controversies in general and the opposing viewpoints in the current interpretation debate in particular.
