Walder Wyss successfully defended the Municipality of Budva (Montenegro) before the Swiss Federal Supreme Court

22. August 2024 – Walder Wyss successfully defended the Municipality of Budva (Montenegro) before the Swiss Federal Supreme Court in an appeal brought by a German contractor against an arbitral award dismissing claims raised in connection with a wastewater treatment project on the Montenegrin coast. The appeal concerned an arbitral award rendered under the ICC Rules with a value in dispute in excess of EUR 40 million. The Federal Supreme Court dismissed the contractor’s appeal in its entirety and awarded the Municipality of Budva a substantial compensation for its costs incurred in the appeal proceedings.

Micha Bühler (Partner at Walder Wyss) and Frédéric Barth (Associate at Walder Wyss) represented the Municipality of Budva before the Federal Supreme Court. The team also included Andreas Daxberger and Dominik Schwarzl (DLA Piper, Vienna) as well as Miroje Jovanovic (Novi Sad) and Dusan Radosavljevic (Belgrade) who had already acted as counsel in the ICC arbitration.
